Freedom of Information Act 2000 - section 14 - appellantās information request found to be āvexatiousā in Information Commissionerās decision notice - First-tier Tribunal (FTT) struck out appellantās appeal on basis of no reasonable prospects of success - reason given by FTT was that appellantās appeal grounds did not engage FTTās jurisdiction per section 58(1) - Held: FTT had not done justice to appellantās appeal grounds - in alleging that costs were a ādrop in the oceanā for public authority, the grounds did allege that the Information Commissionerās information noticeās s14 holistic determination was āwrongā per section 58(1) in finding cost burden āgrossly oppressiveā - error of law for FTT to have considered that appellantās grounds of appeal did not challenge decision noticeās s14 analysis - FTT decision set aside - decision remade, refusing strike-out, as appellantās ādrop in the oceanā argument (as articulated in legal terms, as was proper for an āenablingā tribunal) had realistic, rather than fanciful, prospect of success.
